Plaxico Burress NFL suspension decisionYet another player’s career is going to be left in the hands of NFL commissioner Roger Goodell despite what Plaxico Burress’ lawyer and agent may say about him playing next season.

“I do not see any reason why he should not be able to play this entire season,” said the lawyer, Benjamin Brafman.

The league has specific rules outlined in the NFL’s personal conduct policy and it is up to Goodell to enforce this policy and a players privilege to play, however, his decision will most likely be decided after his legal process has taken its course before any action is taken against Burress.

“We are also confident that the NFL will not have grounds to discipline Plex until after the adjudication of his case after this season. We are hoping to have a deal in place with a team for Plex before training camps start.”

Burress faces a sentence of 3 1/2 to 15 years if convicted after accidentally shooting himself inside the nightclub Latin Quarter on New York’s Lexington Ave. Even after the nightclub security guards had initially turned away Burress, he somehow convinced nightclub management to allow him in.

Reportedly the incident happened as Burress was being led into a VIP area, when the gun slipped and discharged as he fumbled to keep it from falling further down his pant leg.

Secretly the information was leaked to police from within the New York Giants organization and police efforts to charge Plaxico Burress have been hindered by a the New York-Presbyterian Hospital Weill denying he was ever there and missing gun.

For now Roger Goodell had stated Tuesday via email that he is not yet ready to make that determination on Buress’ future. More then just the future of Buress is on the line with what may be one of the clearest violations of the NFL’s personal conduct policy.

Despite the uncertainty for Buress next season, it may have not stopped NFL teams, including the New York Jets, from looking into the unrestricted free agent.

Burress is in fact very fortunate he did not kill anybody and walking back into the league without recourse, after the usual lawyer stalling tactics, should not be an option. The court system remains, innocent until proven guilty, yet the NFL has its own credibility to uphold.
