Yahoo Chalks One Up for Countering Intellectual Rights
Anyone who dare infringe on the intellectual rights of the NFL beware, after all the NFL is and means business. However it may come as a surprise that Yahoo was flexing its muscle at the required royalty fees in order to utilize football related statistics. Yahoo filed a suit last month against the NFLPA claiming the statistics are already public knowledge.
However the NFLPA and Yahoo! have been able to accomplish a settlement over the use of NFL related photos and statistical information and its use with Yahoo’s online fantasy football game. This lead to Yahoo’s decision of a voluntary dismissal with the U.S. District Court on Monday. The settlement could very well be because of similar cases in both the National Football League and Major League Baseball’s interest already having been lost. This includes a similar lawsuit between the NFLPA and CBS Interactive.
Both Yahoo and the union declined to comment on the suit’s dismissal but it is assumed that Yahoo was awarded some form of assurance that it would not have to pay for stats. This could also, very well be a staling tactic by the NFL as it is currently appealing the decision in the CBS Interactive case. Undoubtedly keeping the deal hush hush, would have been one of the NFL’s requirements as it looks to play its hand in any and all cases where other companies look to profit from use of football related information.
In the end Fantasy football is a service provided by the interface, rules and options made available by the specific website a person decides to use. The information itself is and should be considered public knowledge as it would be idiotic to think that numbers and player likenesses equate to what makes fantasy football. Users don’t subscribe or pay for the information, they are their for the experience that is outside of what the NFL provides.
